Terms of Service

The service

ZilchWork, an assumed name (DBA) of Josh Wynn, sole proprietor ("we," "us"), provides subscription software: a CRM with AI agents that answer and place calls and texts, book appointments, send secure payment links, and maintain records for your business ("the Service"). We host, operate, and maintain the platform; you configure your account with your own business information. By purchasing or using the Service you agree to these terms.

Plans, billing, and cancellation

• Plans are billed monthly or annually per business, at the prices shown at checkout. The one-time $99 3-day trial is billed once.
• Annual plans: 12 months of service for the price of 10 ("2 months free"), billed upfront. Annual fees are non-refundable once billed, all sales final. Cancelling an annual plan stops renewal at the end of the annual term.
• Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current rate until you cancel. We will send a reminder before each annual renewal. Cancel anytime from your dashboard or by calling (866) 68-ZILCH; cancellation takes effect at the end of the current period.
• Renewal at our discretion. Just as you may cancel at any time, we reserve the right to decline to renew any subscription at the end of its current billing period, for any reason, with notice before the renewal date. Service you have already paid for is never cut short, and your data export rights are unaffected.
• Subscriptions are month-to-month with no long-term contract. Cancel anytime, cancellation stops future billing at the end of the current billing period.
• All sales are final. Charges already billed, including the trial fee and any completed months, are non-refundable.
• Promotional offers apply only during their stated window.
• Payments are processed by Stripe under their terms.

Fair use

Plans are flat-priced and include ordinary usage for the size of business each plan is built for. There are no per-minute fees, no metered overage charges, and we will never surprise-bill you for usage. If your account's sustained usage runs well beyond what your plan is built for, we will contact you to move you to the plan that fits; that conversation, not a charge, is always the first step. If usage remains far beyond plan scope after notice and no plan change is agreed, we may throttle non-essential outbound volume until the next billing cycle or, in extreme cases, end service under the cancellation terms above. Inbound answering is never throttled.

Your responsibilities

• Provide accurate business information (offers, prices, hours), the AI represents your business based on what you give us.
• Obtain any consent required to contact your leads and customers by phone and text, and use the Service in compliance with applicable laws (including the TCPA and state telemarketing rules). Outbound marketing calls and texts placed with automated or AI-voice technology require prior express written consent.
• Do not load purchased, rented, scraped, or cold third-party lead lists for outbound contact. Claims arising from contacts or lists you provide are your responsibility, as detailed in the Client Onboarding Agreement signed at onboarding.
• Do not use the Service for unlawful, deceptive, or abusive communications.

AI disclosure and limits

The Service uses artificial intelligence, including AI-generated voice. Our AI agents identify themselves as AI. AI output can be imperfect; you are responsible for reviewing important communications and outcomes. The Service does not provide medical, legal, or financial advice.

Conversations and data

Calls and messages handled by the Service may be recorded, transcribed, and logged so you can review them in your CRM and so we can maintain quality. Your data is yours: it is isolated per account, portable, and exportable at any time. See our Privacy Policy.

Acceptable use and suspension

We may suspend or terminate accounts that violate these terms, abuse the platform, or create legal risk (for example, spam or prohibited telemarketing). Where practical we'll warn you first.

Disclaimers and liability

The Service is provided "as is." Demos and examples on this site show how the product works. They are not your results, and they are not other customers' results. To the maximum extent permitted by law, our total liability for any claim is limited to the amounts you paid us in the three months before the claim arose.

Changes to these terms

We may update these terms; material changes will be posted here with a new date. Continued use after changes means you accept them.
